Arbitration

What It Is: Arbitration is a process in which a neutral third party (arbitrator), who is experienced in a case-relevant field such as real estate, construction or employment issues, is appointed to receive evidence and hear testimony during a scheduled arbitration hearing. After the parties have presented their cases, the arbitrator will render - in writing - a final and binding decision. This decision, or Award, can be affirmed by a court having appropriate jurisdiction. Arbitration is less formal, less time-consuming, and more cost-effective than litigation. The process is also confidential.

Often Used For: Disputes where mediation did not result in a resolution; where the parties are seeking a third-party determination; or, where the technical expertise of a neutral third party and his / her understanding of a particular industry is beneficial in order to assess the parties’ arguments and render a final decision.

Fees:

  • Non-refundable administrative fee of $75.00 per party

  • Arbitrators are compensated on an hourly basis for their time to review documents, attend the hearing, and render the final decision, with fees generally ranging between $150.00 and $300.00 per hour
